The Christian Text Exchange reserves the right to implement whatever automated or manual systems are necessary to enforce this policy and by using these services you are indicating that you agree with these terms.

Definitions. As used in this Agreement, the following definitions shall apply.

1. "Christian Text Exchange" shall mean Christian Text Exchange the company, including the ArkWebDesign.com, ArkWebs.com  websites and all operations, online or otherwise, Christian Text Exchange company.
2. "Text ads" shall mean the text that users of the service provide to Christian Text Exchange to act as an advertisement for their site on the Christian Text Exchange system.

"Christian Text Exchange" and "Text ads" shall have the same definition as set out in the preamble hereof.

Faked clicks:
Christian Text Exchange employs both automatic and manual systems to prevent clicks from being faked; either by software or by members repeatedly clicking on their own links. Members who repeatedly click on their own links will be removed from the network.

Acceptable use policy:
Christian Text Exchange is provided to assist you with generating additional traffic for your website. As a condition of your use of the service, you guarantee that you will not use Christian Text Exchange for any purpose that is unlawful, or prohibited by this document. You may not modify, copy, distribute, transmit, display, reproduce, publish, derive works from, transfer, or sell any information, services or benefits obtained from Christian Text Exchange, except with express permission of Christian Text Exchange

You may not use Christian Text Exchange to link to sites that:

• Promote or facilitate hatred of any race, religion, nationality or other subdivision of humanity - all are unique and valuable members of our world's population.
• Harass, abuse, defame, threaten or violate otherwise the legal rights of others, including that of privacy.
• Contain pornography or sexually explicit material.
• Sell, distribute, market or disseminate in any way firearms, munitions, explosives, controlled substances (e.g. illegal recreational drugs), tobacco, pirated goods, stolen goods or any other product or service, which it would not be legal to sell.
• Conduct illegal contests, pyramid schemes, chain or unsolicited mailings.
• Mislead the public in any way.
• Cause Christian Text Exchange to violate any law or statute.
• Facilitate illegal activities.
• Any site Christian Text Exchange demeans to be a cult.

You must not use Text ads, which:

• Use words or phrases, which we deem inappropriate either through their offensive or child insensitive nature, this list of words, is to be applied in a context sensitive manner.
• Contain words that are ALL IN CAPITALS, unless this is a company/brand name when we will use our own judgement.
• Repeat consecutive punctuation marks; e.g. "!!" or "??", the only exception being periods/full stops when we will use our own judgment.
• Use a monetary symbol unless quoting an actual price of an item or service.
• Are misleading about the sites content.
• Offer potentially misleading claims of rewards and prizes.
• Are not in English - since we are only targeting the English-speaking market at present.

Text ads must:

• Be in continuous prose; i.e. a flowing sequence of words.

Decisions are made on a case-by-case basis. Our decision is final. Christian Text Exchange reserves the right to modify Text ads that we feel are inappropriate but will notify the member that we have done so. Any breach of the acceptable use terms may result in the closing of your account as a member. We reserve the right to refuse any listing or Ad we do not approve of.

Please read the Statement of Faith and if you do not agree with it then do not submit your site.

Note: If your listing is approved you may receive periodic updates from the Christian Text Exchange via a email.

Termination
Christian Text Exchange may terminate or suspend provision of any or all services at any time for any reason without the obligation to give notification of this. Although we will, do our best under the circumstances.

Changes to Service
Christian Text Exchange reserves the right to alter, at its own discretion and in the course of normal business, services offered and their conditions. These include and are not limited to the text exchange network itself and the Christian Text Exchange affiliate sites.

Liability Disclaimer
Your access to and use of the Christian Text Exchange is at your own risk. Christian Text Exchange, its members and sponsors, will not be liable for any damage, loss or disclosure of information, data, revenue, accounts or business that occurs in connection with your use of Christian Text Exchange. Christian Text Exchange makes no warrant of any kind regarding the dependability, accuracy, security, timeliness or availability of the services provided. Without limiting the foregoing, Christian Text Exchange and/or its respective suppliers make no representations or warranties about the condition, suitability, reliability, availability, completeness, security, timeliness, or accuracy of the information, or services and materials for any purpose. All are provided "as is" without warranty of any kind. Christian Text Exchange and/or its respective suppliers hereby disclaim all representations, warranties and conditions, express or implied, with regard to this information, software, products, services or materials, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement.

In no event shall Christian Text Exchange and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of services, with the delay or inability to use Christian Text Exchange or related services, the provision of or failure to provide services, or for any information, software, products, services obtained through Christian Text Exchange, whether based on contract, tort, negligence, strict liability or otherwise, even if Christian Text Exchange or its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of Christian Text Exchange, or with any of these terms, your sole and exclusive remedy is to discontinue using the services.

You agree to defend, indemnify and hold Christian Text Exchange and its suppliers harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to legal fees) arising from your violation of these terms. We reserve the right to modify this policy at any time without giving any notice.

This agreement shall be construed and enforced under the laws of the United States.
